The fine print, written in plain English. These terms govern your use of theayposhbrand.com and any service you purchase from us.
By accessing or using theayposhbrand.com (the "Site") or purchasing any service from Ayposh Brand ("we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site or our services.
Ayposh Brand provides digital marketing services including but not limited to Shopify store design, SEO, paid advertising, social media management, logo design, content creation, Google Merchant Center setup, and related consulting. Specific deliverables, timelines, and revisions are defined in the package you purchase or in a separate Statement of Work.
All prices are listed in USD and payable in full before work begins, unless otherwise agreed in writing. Because our services are custom and labor-intensive, payments are non-refundable once work has commenced. If you cancel before any work has started, you may request a refund within 48 hours of purchase by emailing info@theayposhbrand.com.
You agree to provide accurate brand assets, login access where required, and timely feedback. Delays caused by missing information, slow approvals, or third-party platform issues (Shopify, Meta, Google, TikTok, etc.) may extend project timelines and are not the responsibility of Ayposh Brand.
Upon full payment, you own all final deliverables created exclusively for your brand (logos, designs, copy, store assets). Ayposh Brand retains the right to display non-confidential portions of the work in our portfolio, case studies, and marketing materials. Pre-existing tools, templates, and proprietary methodologies remain the property of Ayposh Brand.
We work hard to drive measurable results — sales lifts, ROAS improvements, SEO ranking gains — but we cannot guarantee specific outcomes. Performance depends on product-market fit, ad spend, market conditions, and factors outside our control. Any case-study figures shown on this Site reflect past client results and are not a promise of future performance.
Our services often rely on third-party platforms (Shopify, Stripe, Flutterwave, Google, Meta, TikTok, Klaviyo, etc.). You are responsible for compliance with each platform's terms of service. Ayposh Brand is not liable for account suspensions, policy changes, or pricing changes made by these platforms.
Both parties agree to keep confidential any non-public business information shared during the engagement, including financials, customer data, and strategy documents.
To the maximum extent permitted by law, Ayposh Brand's total liability for any claim arising from your use of the Site or our services shall not exceed the total amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or data.
You agree not to use the Site or our services to engage in fraud, sell illegal products, spam, infringe on intellectual property, or violate any applicable laws. We reserve the right to refuse service or terminate engagements that violate this clause without refund.
Information you submit through contact forms, checkout, or our newsletter is handled in accordance with our internal privacy practices. We never sell your data. We use only the data required to deliver our services and to communicate with you about your project.
We may update these Terms of Use at any time. The latest version will always be posted on this page with an updated effective date. Continued use of the Site or our services after changes are posted constitutes acceptance of those changes.
These Terms are governed by the laws of the United States and, where applicable, the State of Kentucky, without regard to conflict-of-law principles. Any dispute shall be resolved through good-faith negotiation first, and binding arbitration thereafter.
